Terms and Conditions

 

CBRE Urban Photographer of the Year 2014 contest("Contest") Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  THIS CONTEST WILL BE GOVERNED BY ENGLISH LAW.  DO NOT ENTER IF YOU ARE NOT ELIGIBLE.   

 

1. Eligibility

Open only to individuals 13 years of age or older as of date of entry.  Employees, officers and directors of CBRE, Inc. (“Sponsor”), Plan International, and their respective parent, subsidiaries, and affiliated companies, advertising, promotion or production agencies, Web masters/suppliers (and their immediate family members [spouse, parents, children, siblings] and individuals residing in their same household, whether or not related) are not eligible to participate.  By participating, entrants agree to these Official Rules and the decisions of the Sponsor and/or its independent judging agency which are final and binding in all respects.  Void where prohibited, taxed or restricted by law. Subject to all applicable laws and regulations. 

 

2. Contest timing

The Contest begins June 2, 2014 at 12:00:00 pm British Summer Time (“BST”) and ends August 8, 2014 at 11:59:59 pm “BST”  (the “Contest Period”).  Sponsor’s computer is the official clock for this Contest. 

 

3. Contest assignment

The Contest invites the entrant to submit original photos capturing what the entrant considers to be the essence of “cities at work,” at any time of day, be it poignant, inspiring, quirky or amusing (the “Photo” or “Photos”). 

   

4. To Enter

To enter the Contest, visit www.cbreupoty.com (the “Website”).  Then, follow the online instructions to complete an entry form, select your age range, upload and submit your Photo(s), provide a description of the Photo(s), and specify which hour of the day each Photo is meant to represent.  The Photo submitted for a specific hour need not have been taken during that hour, but should look as if it was.

Limit one Photo that represents one hour of the day per person/email address, for a total of twenty-four (24) per person/email address for the entire Contest Period. 

Photo Guidelines: 

  • The Photo must be in .jpg format;
  • The Photo must be between 300KB and 8MB in size; and
  • The Photo cannot have been submitted previously in a promotion or competition of any kind or won previous awards.

Content Restrictions:

  • The Photo must comply with these Official Rules;
  • Sponsor may reject any Photo that shows consumption of alcohol;
  • Sponsor may reject any Photo that promotes illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
  • The Photo must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, trademark rights, or that constitutes copyright infringement;
  • The Photo must not disparage Sponsor or any other person or party affiliated with the Contest;
  • Sponsor may reject any Photo that contains brand names or trademarks other than those owned by Sponsor, which entrant has a limited license to use to incorporate in his/her Photo in this Contest;
  • Sponsor may reject any Photo that contains images or artwork not created by entrant
  • Sponsor may reject any Photo that contains material that is inappropriate, indecent, pornographic, profane, obscene, sexually explicit or suggestive, vulgar, hateful, embarrassing, harassing, misleading or misrepresentative, tortious, defamatory, slanderous or libelous;
  • Sponsor may reject any Photo that contains material that is unnecessarily violent, contains nudity, promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
  • The Photo must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the jurisdiction where the Photo is created.
  • Entrants agree to not post, e-mail or otherwise submit anything that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Sponsor may reject any Photo that contains any personal identification of others such as license plate numbers, personal names, e-mail addresses or street addresses or materials embodying the names, likenesses or other identifying indicia of any celebrities or public figures, living or dead.
  • Sponsor may reject any Photo that communicates messages or images inconsistent with the positive image and/or good will with which Sponsor wishes to be associated;
  • If required by applicable law, entrant must have signed permission from all individuals that appear in the Photo (if any) to use their name, image and/or likeness in the Photo and to grant the rights set forth herein.  If requested, entrant must be able to provide such permissions in a form acceptable to Sponsor; and
  • The Photo must not use a false e-mail address, impersonate any person or entity, or otherwise mislead anyone as to the origin of the Photo.

Sponsor reserves the right, in its sole and absolute discretion, to remove any Entry and disqualify you from the Contest if it believes that the Entry fails to conform to the above Photo Guidelines and/or Content Restrictions or any restrictions set forth in the Official Rules.  Receipt of Entry will not be acknowledged or returned. Only fully completed entry forms are eligible.  Proof of submission will not be deemed to be proof of receipt by Sponsor. 

BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER PHOTO MAY BE POSTED (SUBJECT TO SPONSOR’S DISCRETION) ON THE WEBSITE DURING THE CONTEST PERIOD.  By entering, each entrant warrants and represents the following with respect to their Photos: (a) entrant is the sole and exclusive owner of the Photo; (b) the Photo is entrant’s own creation and is 100% original; and (c) publication of the Photo will not infringe on any rights of any third parties.  Any such entrant will indemnify and hold harmless Sponsor and Releasees (as defined in Section 7) from any claims to the contrary.  Any Photo which is deemed to be inappropriate for publication, obscene or vulgar (all as solely determined by Sponsor), fails to comply with these Official Rules or any Terms of Service on the Website, or violates third party rights will be deemed ineligible.  If Photos are posted to the Website, Sponsor reserves the right to, and may or may not, monitor/screen Photos prior to posting them to the Website.  By entering, you acknowledge that Sponsor has no obligation to use or post any Photo you submit.  No other form of participation other than as stated in these Official Rules is valid. Further, by submitting an Photo, entrant grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to post, publish, edit, modify and otherwise make use of, entrant’s first name, last initial, address (city and state), likeness, photograph, picture, portrait, biographical information, Photo description and Photo  in publication and/or on the internet for, advertising and promotional without notice, payment or consideration to the entrant, except where prohibited by law and warrants and represents that he/she has properly secured, and has all right to grant such permission.  Sponsor suggests that each entrant keep a copy of his/her Photo.   

 

5. The Judging

Preliminary Judging (Ages 16 and above): On or about 25 August 2014, the Chairman of Judges, will evaluate each eligible Photo in accordance with the following equally weighted judging criteria (“Judging Criteria”):

  • Impact
  • Creativity & style
  • Composition
  • Image or print presentation
  • Centre of interest
  • Lighting
  • Colour balance
  • Technical excellence
  • Photographic technique
  • Story telling & subject matter


The Photo that receives the highest total scores based on the Judging Criteria for each hour of the day will be deemed a finalist (each, a “Finalist” and collectively, the “Finalists”).  Each Finalist will receive an Hourly Prize (explained in more detail below) for the hour of the day selected in connection with their Photo, subject to verification.

Finalist Judging (Ages 16 and above): Finalists will be presented to the Judging Committee for evaluation in accordance with the above Judging Criteria. The Photo that receives the highest total scores based on the Judging Criteria will be deemed the potential Grand Prize Winner. In addition, the Photo receiving the highest score in each of three regions (excluding the Grand Prize Photo) ((1) Americas; (2) Europe, Middle East, Aafrica; and (3) Asia-Pacific) will be deemed a potential Regional Prize Winner. In the event a Photo is selected as a Grand Prize or Regional Prize Winner, Hourly Prize will be forfeited and the Photo receiving the second highest score from the Preliminary Judging will be deemed to be the Hourly Prize Winner for that corresponding hour.

Plan International Student Judging (Ages 16-25): On or about 25 August 2014, the Chairman of Judges, will evaluate each eligible Photo in accordance with the Judging Criteria. The Photo that receives the highest total scores based on the Judging Criteria for each hour of the day will advance to be judged by the president of Plan International in accordance with the Judging Criteria. The Photo that receives the highest total scores based on the Judging Criteria as applied by the president of Plan International will be deemed the winner of the Student Prize (explained in more detail below), subject to verification.

Plan International Youth Judging (Ages 13-15): On or about 25 August 2014, the Chairman of Judges, will evaluate each eligible Photo in accordance with the Judging Criteria. The Photo that receives the highest total scores based on the Judging Criteria for each hour of the day will advance to be judged by the youth advisory panel of Plan International in accordance with the Judging Criteria. The Photo that receives the highest potential scores based on the Judging Criteria as applied by the youth advisory panel of Plan International will be deemed the Youth Winner (explained in more detail below), subject to verification.

For all judging, in the event of a tie, the tie-breaker will be based upon the highest score in the first judging criteria set forth above, continuing thereafter to each judging criteria in the order set forth above, as needed, to break the tie.  In the event that a tie still remains, a new judge, selected by the Sponsor in its sole discretion, will judge the tied entries based on the judging criteria set forth above.   Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and judge’s decisions, which are final and binding in all matters related to the Contest.

C. GRAND PRIZE (1): One (1) winner will receive a photo safari holiday. CBRE will provide a selection of travel agencies with which winner may work to plan the trip and CBRE will cover costs associated with the trip up to £5,000/$8,381.75USD. Prize includes: (i) round-trip, coach class air transportation for the winner from the major commercial airport near winner’s residence (as determined by Sponsor in its sole discretion) to chosen destination and (ii) hotel accommodations for seven (7) nights in one (1) standard hotel room. ARV: £5,000/$8,381.75USD. Actual value of trip may vary based on point of departure and airfare fluctuations.  Any difference between stated approximate retail value and actual value of prize will not be awarded.  If Winner is located in the United States, Winner will receive an IRS form 1099 for value of prize. All prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion. Selection of the airline, departure and arrival airport, and hotel are solely within Sponsor’s sole discretion.  If, in the judgment of Sponsor, air travel is not required due to a winner's proximity to chosen location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole and absolute discretion.  The difference in value will not be awarded to the winner.  Prize(s) are non-transferable, are not redeemable for cash and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to, ground transportation to/from winner’s residence and departure airport, in-room charges (e.g., mini-bar, room service, telephone, movies, etc.), meals and beverages, gratuities, travel upgrades, baggage fees, and personal incidentals. Travel must be completed by August 30, 2015. Winner will be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel’s sole discretion upon hotel check-in and all in-room charges, telephone calls, meals, beverages, hotel upgrades, amenities, personal incidentals and any other expenses charged to the winner’s hotel room will be charged to that major valid credit card or deducted from the deposit provided. Travel is subject to terms and conditions set forth in these Official Rules and those set forth by selected travel providers, availability and other material restrictions may apply. Winner must have all necessary identification and/or travel documents (e.g., a valid passport) required for travel. Sponsor is not responsible for any fees or additional charges resulting from a winner’s change to itinerary or accommodations. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. Winner is responsible for obtaining his/her own medical and life insurance and the associated costs. All travel is subject to any and all restrictions instituted by the U.S. Department of Defense and/or Department of Homeland Security, as required.  Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles.  All airline tickets are subject to flight variation, work stoppages, and schedule or route changes.  Additional prize award details and travel information to be provided to the winner at the time of notification.  Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. 

D. STUDENT PRIZE: One (1) 64 GB Apple iPad (WiFi only). ARV: £500/$838USD.

E. YOUTH PRIZE: One (1) 64 GB Apple iPad (WiFi only) awarded to an educational institution or community organization identified by Youth Prize Winner at the time of winner notification. NO PRIZE IS AWARDED TO THE WINNING YOUTH ENTRANT. YOUTH PRIZE IS AWARDED TO THE ORGANIZATION IDENTIFIED BY YOUTH ENTRANT. Sponsor reserves the right to request Youth Prize Winner to select  alternate school or community organization, at Sponsor’s sole discretion. ARV: £500/$838USD.

ALL PRIZES: On or about 1 October 2014, the potential winners will be notified via email. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.  The winners will be required to complete, sign, and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within seven (7) calendar days of first notification attempt. If winner is a minor in his or her country of residence, prize will be awarded to the winner’s parent or legal guardian who will be required to complete and sign all paperwork. If winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Official Rules and requirements, such prize will be forfeited and may be awarded to the Photo with the next highest score. Upon prize forfeiture, no compensation will be given. No substitution, cash equivalent or transfer of prize, but Sponsor reserves right to substitute prize with prize of equal or greater value if advertised prize is unavailable for any reason.  All unspecified expenses are the responsibility of winner.  Limit one Grand Prize or one Regional Prize per person/email address. Total ARV of all prizes: £16,650/$27,911USD. Apple, Inc. is not a sponsor of this Contest. Apple and iPad are trademarks of Apple Inc., registered in the U.S. and other countries.

 

7. General conditions


Winner may be required to obtain releases from any and all third parties appearing in their respective Photos, in Sponsor’s sole discretion.  To the maximum extent permitted by law, entrants and winner agree that Sponsor and its parent, subsidiaries and affiliated companies and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively “Releasees”) will have no liability whatsoever for, and are released and shall be held harmless by participants and winner against, any liability, for any losses or damage or violation of intellectual property or personal rights (such as but not limited to, copyright, trade name/trademark, and/or rights of privacy or publicity or portrayal in a false light) and merchandise delivery, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Contest or related activity and the use of the Photo submitted.  As a condition of entering, entrants further agree to these Official Rules and to the judges’ decisions, which are final and binding in all respects, and that to the maximum extent permitted by law: a) under no circumstances will entrant be liable to Sponsor, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with this agreement for: (i) loss of profits; (ii) loss of sales or business; (iii) loss of agreements or contracts; (iv) loss of anticipated savings; (v) loss of or damage to goodwill; (vi) loss of use or corruption of software, data or information; (vii) any indirect or consequential loss; (viii) punitive damages; and b) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action. Nothing in this agreement excludes the liability of the Sponsor (a) for death or personal injury caused by the Sponsor's negligence; or (b) for fraud or fraudulent misrepresentation where such limitations of liability are prohibited by law.


ENTRIES POSTED TO THE WEBSITE ARE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.  Any waiver or non-use of any rights hereunder by Sponsor does not constitute a general waiver of any other Sponsor rights.  By submitting a Photo, entrant agrees that entrant’s submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Photo on a non-confidential basis to anyone or otherwise use, exploit and assign the ideas without any additional compensation or notice to, or approval from, entrant or any third party.  Entrant acknowledges that, by acceptance of entrant’s Photo, Sponsor does not waive any rights to use, assign or otherwise exploit similar or related ideas previously developed or known to Sponsor, or developed by its employees, contractors and agents, its affiliates and their employees, contractors and agents, or obtained from sources other than entrant and entrant agrees that he/she shall not have or make any claim against Releasees resulting from such use, assignment or other exploitation.  If  any potential winner is found to be ineligible or not in compliance with these Official Rules, or if any of the prize notifications or prizes are returned as undeliverable, the prize in its entirety may be forfeited.  Federal, state and local taxes, fees and other levies on prize are solely the winner’s responsibility. 

Copyright in all Photos remains the property of the entrant at all times. Following the conclusion of the Contest, should Sponsor choose to use any Photo, for any purpose other than in connection with the Contest, Sponsor shall be eligible to license such Photo from entrant at a 50% discount off of standard stock house rates. Sponsor shall have no obligation to use any Photos, in any way whatsoever. 

 

8. Liability Limitations

Releasees are not responsible for lost, late, misdirected, incomplete, or non-delivered Photos or e-mail; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of Photo or other information or the failure to capture, or loss of, any such information.  Persons who tamper with or abuse any aspect of this Contest or otherwise attempt to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, as solely determined by the Sponsor, will be disqualified.  Any use of robotic, automatic, macro, programmed or like entry methods will void all such Photos by such methods, and disqualify any entrant using such methods.  Neither Sponsor nor its agencies are responsible for injury or damage to entrant’s or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Website.  Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Photos, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and select the prize winner from Photos received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.  Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of this Website.  In case of dispute, the authorized account subscriber of the e-mail account used to enter the Contest at the actual time of entry will be deemed to be the entrant, and must comply with these Official Rules.  The authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet Access Provider, on-line service provider, or other organization which is responsible for assigning e-mail addresses. 

By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of England and Wales, without giving effect to any choice of law or conflict of law rules.  By entering, entrants consent to the jurisdiction and venue of the courts located in England. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

9. use of data

Sponsor will be collecting personal data about entrants online for the administration of the Contest, in accordance with its privacy policy.  Please review the Sponsor’s Privacy Policy.  By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.  Entrants also agree that if they are selected as a winner, their information may also be included in a publicly-available winner’s list.
